Statement Regarding Pending Lexi Love Federal Trademark Litigation

SELENA SCOLA (aka LEXI LOVE®) is the owner of the federally registered LEXI LOVE® trademark, a SAG-AFTRA actor, and the senior user in commerce since 2004.

The pending action in the United States District Court for the Northern District of California (Case No. 3:25-cv-10837) arises from the unauthorized commercial use of an identical mark by Cody Barnes, amplified at scale by Paramount Skydance Corporation and World of Wonder Productions, Inc.

Defendants (Paramount Skydance Corporation; World of Wonder Productions, Inc.; Cody Barnes) are advancing a dangerous legal theory while seeking to invalidate and cancel Plaintiff’s (Selena Scola, aka Lexi Love®) trademark rights. In their filings, Defendants assert that a corporation can take an identical trademark, broadcast it globally within a televised entertainment program, and avoid liability by invoking the First Amendment—even where the mark is used to identify and promote a real performer in direct commercial competition. They further contend that this use is not actionable trademark use or source identification, while simultaneously exploiting that same mark for profit. Defendants are attempting to cancel Scola’s federally registered LEXI LOVE® mark—backed by more than twenty years of continuous use—while using that identical mark for their own commercial gain.
